Terms of Use

The rules for using Exscroll’s app, website, earned-time controls and subscription features.

1. Agreement and App Store terms

These Terms of Use (“Terms”) are an agreement between you and Exscroll, the service operated by the independent developer responsible for the Exscroll App Store listing. They apply to the Exscroll iOS app, website and related support services. By downloading, accessing or using Exscroll, you agree to these Terms. If you do not agree, do not use Exscroll.

Apple’s Standard Licensed Application End User License Agreement also applies to the iOS app unless a valid custom licence replaces it. These Terms supplement that agreement. If a mandatory Apple term or non-excludable consumer law conflicts with these Terms, that mandatory term controls.

Apple is not responsible for Exscroll’s maintenance or support except as required by applicable App Store terms. To the extent required by Apple’s minimum terms, Apple and its subsidiaries are third-party beneficiaries of the licence terms and may enforce them.

2. Eligibility and minors

You must be at least 13 to use Exscroll. If you are under the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms and supervise your use, exercise activity, device-control setup and purchases. If local law requires a higher minimum age or verified parental consent, that requirement applies.

You may use Exscroll only where doing so is lawful and where you can safely perform the selected activity. Parents and guardians are responsible for deciding whether Exscroll and each exercise are appropriate for a minor.

3. Licence and ownership

Subject to these Terms and the App Store rules, Exscroll grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to install and use the app on Apple-branded devices you own or control, including permitted Family Sharing use. The licence is for personal, non-commercial use unless we agree otherwise in writing.

Exscroll, its software, visual design, Guardian icon, game systems, text, graphics, monsters, badges, trademarks and other content are owned by or licensed to Exscroll and are protected by intellectual-property law. These Terms do not transfer ownership to you.

You may not copy, sell, rent, sublicense, distribute, publicly exploit, scrape, frame, modify, create derivative works from, reverse engineer, decompile or attempt to extract source code from Exscroll except to the limited extent a restriction is prohibited by law or an open-source licence expressly permits it.

Feedback

If you voluntarily send suggestions or feedback, you grant Exscroll a worldwide, perpetual, irrevocable, royalty-free right to use, adapt and incorporate it without payment or attribution, provided we do not publicly identify you without permission.

4. Accounts, sync and security

Exscroll creates an anonymous Firebase account when the configured app starts so onboarding has no account wall. You may later protect the same account with email/password or Sign in with Apple, or sign into an existing account. You are responsible for your device, credentials and activity under your protected account.

  • Provide accurate information and do not impersonate another person.
  • Keep credentials and access to your email or Apple account secure.
  • Notify us promptly through the contact form if you suspect unauthorised account use.
  • Cloud sync is a continuity feature, not a guaranteed backup. Keep control of the device and account you rely on.

Deleting a protected account removes access to known synced Exscroll progress and cannot be undone, subject to provider backup timing and legally retained records. Uninstalling the app does not automatically delete an anonymous Firebase account. Deleting the app or Exscroll account does not cancel an App Store subscription.

5. Fitness, health and safety

Exscroll is a general wellness and habit tool, not medical advice.It does not diagnose, treat, cure or prevent any disease or condition and is not a substitute for a doctor, physiotherapist, trainer or emergency service.

Exercise involves inherent risk. Before exercising, consider your health, ability, surroundings and any professional advice you have received. Use stable equipment and enough clear space; wear suitable clothing and footwear; keep the phone safely positioned; use correct form; warm up; stay hydrated; and obtain adult supervision where appropriate.

Stop immediately if you feel pain, faintness, chest discomfort, unusual shortness of breath, loss of balance or other concerning symptoms. Seek urgent medical help when appropriate. Do not exercise while driving, in traffic, near hazards, or where focusing on the app could endanger you or another person.

You choose which exercises to attempt and remain responsible for deciding whether they are safe and suitable. To the extent allowed by law, you accept the ordinary risks inherent in voluntary exercise; nothing in these Terms excludes liability that cannot legally be excluded.

6. Automated verification, steps and in-app rewards

Exscroll uses on-device Apple Vision pose detection and configured movement rules to estimate whether a rep or hold meets the app’s criteria. It also reads eligible Apple Health steps with permission. Hardware, lighting, clothing, framing, movement style, sensor data, permissions and software limitations can cause miscounts, rejected reps, duplicate activity or unavailable tracking.

Verification is designed only to award in-app minutes, journey progress and other game state. It is not a clinical assessment, identity check, official fitness measurement or decision with legal or similarly significant effect. We do not guarantee that every movement or step will be detected or rewarded.

Earned minutes, coins, streaks, quests, trophies, encounters, ranks and other virtual items have no cash value, are not property, cannot be sold or transferred and may be corrected, rebalanced or removed where needed to fix errors, prevent abuse or update the service. You must not falsify steps, manipulate sensors or exploit verification to obtain rewards.

7. Screen Time and device controls

Exscroll uses Apple Family Controls, Managed Settings and Device Activity to shield the apps, categories or web domains you voluntarily select and to provide timed access using earned minutes. These controls depend on compatible Apple hardware, iOS, Apple entitlements, permissions, Screen Time services, extension processes and correct setup.

Exscroll does not guarantee that blocking or unlocking will be uninterrupted, tamper-proof, available on every device, or suitable as a parental-control, workplace, clinical, addiction-treatment, emergency or safety-critical system. iOS changes, device restarts, permission changes, uninstalling, Apple service behaviour, extension limits or other software can affect controls.

You remain responsible for access to essential communications, emergency services, transport, authentication, health, banking and other important apps. Do not select an app if blocking it could create danger or prevent access you may urgently need. Hard Mode and similar friction features are voluntary; understand their effect before enabling them.

8. Subscriptions, billing and cancellation

Exscroll may offer monthly or annual auto-renewing subscriptions. The product, price, currency, billing period, eligibility and any promotional offer are shown in Apple’s purchase sheet before you confirm. Apple charges your App Store account and handles payment details; RevenueCat helps Exscroll validate receipts and entitlements.

  • A subscription renews automatically unless cancelled at least 24 hours before the end of the current period, subject to Apple’s then-current rules.
  • Apple may charge renewal within 24 hours before the current period ends.
  • Manage or cancel in your Apple ID subscription settings. Deleting Exscroll or your Exscroll account does not cancel.
  • Use “Restore purchases” with the relevant App Store account to check for an existing entitlement.
  • Apple handles refunds and billing disputes under its policies and applicable consumer law.
  • If Apple’s purchase sheet offers a trial or promotion, the conditions shown there apply. Exscroll does not promise a trial unless that sheet expressly offers one.

Prices and product features may change prospectively. Apple or Exscroll will provide any notice required by law or App Store rules. Your statutory rights are not affected.

9. Acceptable use

You must not:

  • use Exscroll unlawfully, fraudulently, abusively or in a way that harms another person;
  • circumvent, probe or interfere with authentication, Firestore rules, the contact inbox, rate limits, Screen Time logic, purchase checks or other security;
  • use bots, scripts, modified clients, falsified steps, sensor manipulation or exploits to create activity or rewards;
  • upload or transmit malware, excessive traffic, spam, harassment, threats, unlawful content or another person’s personal data through the website form;
  • impersonate Exscroll, Apple, another user or any other person;
  • use Exscroll to build, train, benchmark or commercialise a competing service without written permission;
  • remove ownership notices or misuse Exscroll’s branding.

Contact-form messages are for genuine support, privacy, partnership, press or related enquiries. Do not send passwords, payment-card details, detailed medical records or content you do not have the right to share.

10. Privacy

The Exscroll Privacy Policy explains how the app and website handle data. By using optional device permissions, you also use controls supplied by Apple. You can change those permissions in iOS and Apple Health settings, but disabling one may prevent the related feature from working.

11. Third-party services and links

Exscroll relies on Apple services, Firebase and RevenueCat and may link to external research, subscription settings or websites. Those services have separate terms and privacy notices. Exscroll does not control their availability, content, security or decisions and is not responsible for third-party services except where law says otherwise.

Apple has no obligation to provide maintenance or support for Exscroll. If the app fails to conform to an applicable warranty, you may notify Apple and Apple may refund the app purchase price, if any, as required by its terms; to the maximum extent permitted by law, Apple has no other warranty obligation for Exscroll.

12. Availability, updates and changes

Exscroll is evolving and is currently distributed through TestFlight before public App Store release. TestFlight builds may expire, contain unfinished functionality, reset or change data, and be unavailable without notice. Do not rely on a beta build for a safety-critical purpose.

We may add, change, rebalance, suspend or discontinue features; change exercise rules or rewards; update supported devices or iOS versions; repair or reset corrupted progress; and issue updates needed for security, law, Apple requirements or service operation. Some updates may be required to continue using Exscroll.

We aim to preserve legitimate progress but cannot guarantee uninterrupted service, permanent availability, compatibility with every future iOS version, or loss-free sync. Planned maintenance and events outside reasonable control may interrupt access.

13. Suspension and termination

You may stop using Exscroll at any time and may delete a protected account in the app. You must separately cancel any App Store subscription.

We may limit, suspend or terminate access where reasonably necessary to address a serious or repeated breach of these Terms, fraud, security risk, legal requirement, harm to another person, misuse of Apple/Firebase/RevenueCat services, non-payment, or discontinuation of Exscroll. Where appropriate and lawful, we will give notice and a reasonable opportunity to remedy.

Licence, ownership, feedback, payment, disclaimer, liability, dispute and any other provisions that by nature should survive will continue after termination.

14. Disclaimers

To the fullest extent permitted by law, Exscroll is provided “as is” and “as available”. We disclaim implied warranties or conditions of merchantability, fitness for a particular purpose, satisfactory quality, non-infringement, uninterrupted availability and accuracy, except where they cannot legally be disclaimed.

We do not promise any particular fitness, health, attention, productivity, screen-time, habit, weight, performance or wellbeing result. Examples, estimates, streaks, forecasts and earned-time previews are illustrative and depend on your settings and activity.

Nothing in these Terms limits statutory guarantees or remedies you have as a consumer that cannot be waived.

15. Limitation of liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, wilful misconduct, breach of a non-excludable statutory duty, or any other liability that law does not permit us to exclude.

Subject to that rule and to the fullest extent permitted by law, Exscroll is not liable for indirect, incidental, special, consequential or punitive loss; loss of profit, revenue, business, opportunity, goodwill or anticipated savings; loss or corruption of data; or loss caused by third-party platforms, device failure, unsupported configuration or your unsafe or unlawful use.

Where liability can lawfully be limited, Exscroll’s total aggregate liability arising from the service or these Terms will not exceed the greater of (a) the amount you paid for Exscroll during the 12 months before the event giving rise to the claim and (b) US$100 or its equivalent in your local currency. This cap does not apply where a higher minimum remedy is required by consumer law.

Business users

If you use Exscroll on behalf of a business contrary to the personal-use licence or with written permission, you will indemnify Exscroll against third-party claims, losses and reasonable costs caused by your unlawful use, infringement or material breach, except to the extent caused by Exscroll. This indemnity does not apply to consumers acting wholly outside a trade or profession.

16. General terms

Applicable law and disputes

These Terms do not deprive consumers of mandatory rights, statutory guarantees or access to courts provided by the law of their habitual residence. Where the law permits a choice, these Terms are governed by the law of the country or region in which the Exscroll operator is established, excluding conflict-of-law rules, and the courts there have non-exclusive jurisdiction. Consumers may also bring a claim in any court available under mandatory local law. Before formal proceedings, please contact us and give us a reasonable opportunity to resolve the issue.

Changes to these Terms

We may update these Terms to reflect new features, providers, risks, law or App Store requirements. We will post the updated version, change the effective date and give additional notice where required. Continued use after the change takes effect means you accept the updated Terms; if you do not agree, stop using Exscroll and cancel any subscription.

Severability, waiver and assignment

If a provision is unenforceable, it will be limited or removed only as necessary and the rest will continue. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them as part of a genuine reorganisation, financing or transfer of Exscroll, subject to applicable law and notice.

Entire agreement

These Terms, the Privacy Policy, Apple’s applicable licence and the purchase terms shown by Apple form the agreement for Exscroll and supersede earlier statements about the same subject, without limiting rights based on fraud or mandatory law.
